New Law Change for Expungements of Felonies and Misdemeanors

The Second Chance Act removes obstacles for North Carolinians who struggle to find employment because of their past criminal history by reducing the timeframe that residents can obtain expungements. Call Narain Legal at (910) 763-7420 to discuss options to expunge your record.

With this law, North Carolinians who have done their time and reformed their lives will have the opportunity to live as if they had never been charged or convicted of a crime.

An expungement of a criminal record is the destruction of police records of an individual’s convictions. An expungement is sometimes called an "expunction." Expungements can help people avoid the long-term consequences of a permanent criminal record.

Under current law certain felonies and misdemeanors committed before Dec. 1, 2019, may be expunged from a juvenile’s record. The law also reduces the time frame that certain nonviolent crimes can be removed from an adult’s record.

Starting Dec. 1, 2020, North Carolinians with criminal records can seek the expungement of more than one misdemeanor conviction after seven years instead of waiting five years for each misdemeanor, or 10 years for one felony.
